Jury in Elbit trial of Greenstein and others ‘deadlocked’ – judge orders ‘majority verdict’

The jury in the trial of Palestine Action protesters, including well-known Jewish activist Tony Greenstein, for intent to damage a production facility of Israeli weapons manufacturer Elbit has told the judge that it is ‘deadlocked’ – unable to achieve a unanimous verdict. The numbers on either side are not known.

The judge has sent a note to the jury that they must now return a majority verdict – one of at least ten to two out of the twelve jurors.

Greenstein has pointed out that informing jurors of their right to decide according to their conscience is now being construed as a criminal offence, with climate activist Trudi Warner set to be charged for holding up a placard outside the trial of a fellow activist:

Greenstein also noted that it is an offence under UK law to be ‘ancillary’ to international war crimes under the International Criminal Court Act 2001:

51 Genocide, crimes against humanity and war crimes

(1) It is an offence against the law of England and Wales for a person to commit genocide, a crime against humanity or a war crime.

(2) This section applies to acts committed—

(a) in England or Wales, or

(b) outside the United Kingdom by a United Kingdom national, a United Kingdom resident or a person subject to UK service jurisdiction.

52 Conduct ancillary to genocide, etc. committed outside jurisdiction

(1) It is an offence against the law of England and Wales for a person to engage in conduct ancillary to an act to which this section applies.

(2) This section applies to an act that if committed in England or Wales would constitute—

under the International Criminal Court Act 2001 would be well founded. Sections 51 and 52 of this Act state that:

51 Genocide, crimes against humanity and war crimes

(1) It is an offence against the law of England and Wales for a person to commit genocide, a crime against humanity or a war crime.

(2) This section applies to acts committed—

(a) in England or Wales, or

(b) outside the United Kingdom by a United Kingdom national, a United Kingdom resident or a person subject to UK service jurisdiction.

52 Conduct ancillary to genocide, etc. committed outside jurisdiction

(1) It is an offence against the law of England and Wales for a person to engage in conduct ancillary to an act to which this section applies.

(2) This section applies to an act that if committed in England or Wales would constitute—

      (a) an offence under section 51 (genocide, crime against humanity or war crime), or

      (b) an offence under this section,

but which, being committed (or intended to be committed) outside England and Wales, does not constitute such an offence.

(3) The reference in subsection (1) to conduct ancillary to such an act is to conduct that would constitute an ancillary offence in relation to that act if the act were committed in England or Wales.

(4) This section applies where the conduct in question consists of or includes an act committed—

      (a)        in England or Wales, or

(b) outside the United Kingdom by a United Kingdom national, a United Kingdom resident or a person subject to UK service jurisdiction.

Despite this clear legislation, the trial judge has continually prevented the defendants from bringing their motivation to prevent the murder of Palestinian civilians as part of their defence.

The trial had already descended into farce when the prosecuting barrister refused to accept that photographic evidence showed that Greenstein’s disabled parking badge, which she had claimed was in the rear of the group’s van to try to prove that he had played a more active role than merely driving the vehicle, was in fact on the dashboard in police photographs of the impounded van.

The verdict is expected today, assuming the jury is able to reach a 10-2 position.

Even if he were being slightly figurative in his speech, she’s much too clever (read “sneaky’) to actually use those precise words anywhere near the mass media, but she is, to quote the subject of Skwawkies’ article, the most despicable politician in Britain today, who combines Zionism, racism, admiration for a Hitler loving anti-Semite & hostility to the disabled & claimants – “a Bigot for All Seasons”.

        No. My words didn’t say that. She might not be on record as saying it, but she’s an avowed 1-state zionist: she supports the suppression and occupation of Palestine – so she possibly believes it.
