South Africa to file legal action with ICJ against UK, US, for war crime complicity

Nation whose case put Israel formally on trial for genocide joins Nicaragua in turning its sights on accomplices in genocide

A team of almost fifty South African lawyers is preparing a legal case to bring to the International Court of Justice (ICJ), the United Nations’ top court, against the US and UK, for their complicity in Israel’s array of war crimes in Gaza and the occupied West Bank.

South Africa’s successful ICJ case against Israel last month led to Israel being put formally on trial for genocide and resulted in a string of binding orders on Israel to stop its slaughter of Gazans and even to protect Palestinians from harm, as well as to ensure adequate aid reaches the strip’s 2.5 million people, many of whom are now starving and homeless.

Israel has flouted the rulings, continuing and even intensifying the mass murder and blockade, and is being supported in its flagrant disregard for international law by the UK and US, who are providing both material and financial aid, and giving political cover by refusing to condemn Israel’s actions or to call its crimes what they are, instead casting doubt on the mass deaths and brutality and denigrating the Court’s ruling.

South Africa joins Nicaragua in taking action against the UK and US. The Central American nation has also filed a case against Germany, Canada and the Netherlands.

The team of lawyers, which already numbers around fifty, is likely to grow further as more lawyers are set to join from other nations. Wikus van Rensburg, who is leading the action, said that it was time for the US and other complicit nations to “be held responsible for [their] crimes”.

  3. Maybe they get the overdue wake-up call. All these countries will hopefully face the consequences of their complicity. Chuffed that South Africa and Nicaragua are taking this action.

  4. I am glad to see that US and UK ,amoral Zionist warmongers and genocide deniers, are being brought to the highest court in the world by South Africa for complicity in war crimes. Nicaragua has also taken a case against them and the other war mongers for complicity in genocide.
    The slaughter of Palestinian innocents has distressed and revolted decent people the world over irrespective of their governments’ and their establishments support for Israel’s depravity.
    In my opinion much of this support is down to money e.g. in the UK “donations” to individual politicians and political parties and their Friends of Israel organisations are well documented- bought and paid for springs to mind as the reason why seemingly normal sane people defend Israel’s “right” to commit atrocities in so called self defence against a terrified unarmed civilian population.
    And of course if the carrot doesn’t work there is always the stick. I have no doubt many support Israel because they are scared not to -they have families and jobs and they don’t want to be branded “antisemites” and sacked from their employment like Prof. Millar was. ( I am absolutely delighted he won his case which will maybe enable some of those intimidated into silence to speak out). Others fear blacklisting and worse.
    Increased revenue and taxes from arms sales is also a reason why governments support Israel. A prime example is Germany. We are told that Germany’s guilt over the Holocaust is the reason for its unequovical support for Israeli genocide and war crimes but in fact during the war on Gaza German revenue from arms sales has increased by 1000% so it seems money not guilt is the motivation there.
    I would love to know by how much the profits of BAE and other arms manufacturers in the UK have increased during this time but as far as I am aware those figures are not yet in the public domain
    The profits from arms sales to Israel and all of the rest of it will come out if the ICJ finds the UK and the others have a case to answer Given the earlier judgement about plausible genocide it is very likely the ICJ will go on to try the countries concerned and we will have to live with the shame of that forever. However we will still be better off than the 30,000 palestinians, many of them little children, who don’t live with anything any more. They were murdered in hospitals, refugee camps, schools or asleep in their own homes by Israel and its accomplices in genocide and war crimes. Many more will die of starvation ,thirst and disease as well as by shooting and bombing if the criminal onslaught against them continues.
    Solidarity with South Africa and Nicaragua and the other civilised law abiding countries like Spain and Belgium who are trying to halt the war on innocents by legal means and/or sanctions against the rogue state of Israel.

    1. I wonder if the pollsters asked them WHY (they oppose a deal to end the war etc)! Probably not. But the thing we always have to bear in mind is that most, if not ALL of these people, believe all the atrocity claims/propaganda, and are no doubt unaware that a significant number of the Israelis who were killed on October 7th were killed by the IDF. And, most importantly, that BN and Co knew in advance that an attack was coming and, as such, deliberately let it go ahead.

      Just in case anyone missed it (when I linked to it recently), in the wikipedia entry for the October 7th attack it says the following, under the heading Advance Israeli knowledge:

      The Haaretz article is behind a paywall, so I don’t know what it says of course beyond the headline and the first bit of the article, but it would be interesting to learn how Haaretz came by this information, AND, if anyone from Shin Bet or the IDF military commanders gave a reason for why they DIDN’T warn the Nova Music Festival organisers and tell them to call off the festival.

        I think it’s blatantly obvious to anyone with a modicum of critical thinking that the whole thing was a conspiracy by the Dirty Tricks Brigade of Israel and the US and UK and other countries, and all planned in advance of the ICJ ruling. But if we play their game and pretend they are sincere – i.e. the countries which have suspended their funding to UNRWA – then surely the Channel 4 News ‘examination’ convinced them that the allegations are fraudulent….. as if the timing itself of the ‘revelations’ wouldn’t have been evidence enough!

      3. The long-established investigative principle is that someone who benefits from a crime is a logical suspect. In other words, who benefits?
        It is interesting that the attack on 7 October last year has been described as Israel’s 9/11.
        A careful look at the evidence leads me to conclude that the Bush administration was complicit in 9/11 by deliberately allowing it to happen. It is reasonable to ask ourselves if that is also true of Netanyahu and 7 October.

    “Today the International Court of Justice delivered its judgment on the preliminary objections raised by Russia on jurisdiction and admissibility in the genocide case that Ukraine had brought against it after the full-scale invasion in February 2022. Bottom line – Ukraine lost pretty badly. Readers will recall that this case is different from all of the other genocide cases brought before the Court so far, including the most recent one, South Africa v. Israel. While in all other genocide cases the claim is that the respondent committed genocide, in Ukraine v. Russia the claim is that Russia falsely asserted that Ukraine committed genocide against Russians or Russian-speakers in Ukraine, and on that basis then proceeded to invade Ukraine.

    So this is a genocide case in reverse. What is creative about it is that Ukraine had cast the whole of Russia’s ‘special military operation’ as in some sense being inconsistent with the Genocide Convention, without itself being genocidal. In making this argument, Ukraine tried to avoid the Court’s jurisdictional constraints, which made it impossible to sue Russia for aggression, or for violating the UN Charter more generally, or for committing war crimes and crimes against humanity.

    In its provisional measures order, the Court, by 13 votes to 2, thought that Ukraine’s creative argument was plausible, and ordered Russia to stop the invasion (which it of course refused to do). But even within that majority, one judge – Judge Bennouna – indicated that the argument will fail at the later stages of the case. So the issue for the Court in the preliminary objection judgment delivered today was precisely to rule on the validity of Ukraine’s argument purely as a question of the Convention’s interpretation – a non-obvious issue not only because this kind of genocide case wasn’t litigated before, but also because there is no article in that treaty that clearly applies to false allegations of genocide or to uses of force based upon them.”

    Bottom line: Despite the fantasy reporting of what passes for media in the Collective West, Ukraine – along with its Western elites sponsors – got their collective arses handed to them legally by the iCJ. Just like they have had their collective arses handed to them militarily.

    The South African Government said that it had submitted an urgent request to the International Court of Justice (ICJ) regarding Israel’s intention to expand its military offensive in the densely overcrowded southern Gaza city of Rafah.
    In a statement published on Tuesday, the government said it asked the Court “to consider whether the decision announced by Israel to extend its military operations in Rafah, which is the last refuge for surviving people in Gaza, requires that the Court uses its power to prevent further imminent breach of the rights of Palestinians in Gaza.”
