International law expert agrees: “It’s clear there’s a case” against complicit EU officials

United Nations special rapporteur for Palestine Francesca Albanese has said that senior European Union officials, including European Commission (EC) President Ursula von der Leyen, must be held accountable for complicity in war crimes for backing Israel in its genocide in Gaza. Albanese said that:
They will have to understand that immunity cannot equate with impunity.
The fact that the two highest figures of the EU continue business as usual engagements with Israel is beyond deplorable. I’m not someone who says, ‘History will judge them’ — they will have to be judged before then. And they will have to understand that immunity cannot equate with impunity.
Israel has slaughtered more than 200,000 people in Gaza, mostly women and children, since the Israeli military killed most of the Israelis who died on October 2023 – and is now engaged in the deliberate starvation of almost two million survivors, with almost 300,000 children close to death from hunger.
Former EU head of foreign affairs Josep Borrell said last month:
It is impossible not to see this as an intent to exterminate.
But his replacement Kaja Kallas has followed Israel’s propaganda line that Hamas is to blame for Israel’s actions since the engineered collapse of the so-called ceasefire – Israel continued bombing daily throughout it – in March and has promised continued “solidarity with Israel”.
Von der Leyen is already the subject of a complaint filed with the ICC last year for complicity in war crimes and crimes against humanity in Gaza, but the court has not yet agreed to prosecute. Humanitarian law expert Mouin Rabbani has pointed out the pair’s failure to take seriously the EU/EC’s obligations under international law to prevent genocide and agreed with Albanese’s call to prosecute:
The 1948 Genocide Convention calls upon signatories to not only punish but also prevent genocide. Here we have the two senior EU officials not only refusing to take even symbolic action to prevent genocide, but actively normalising and supporting it in the full knowledge that their backing enables the crimes they nominally oppose.
So of course, Special Rapporteur Albanese’s points and observations are spot on and entirely correct.
Middlesex University genocide expert Prof William Schabas doubted that the ICC will act but said the case against von der Leyen et al is ‘clear’:
It’s clear that there is a case. Not all of Israel’s supporters around the world would be ‘accomplices’ but she’s the head of a very important intergovernmental organisation and is encouraging Israel.
Albanese said she is also working on a report that will “expose banks, pensions funds, tech companies, and universities for complicity in Gaza’s destruction”, according to the Intercept:
All those implicated and involved in the unlawful occupation, in providing it with support, are aiding and abetting violations of international law and human rights violations and a number of these amount to crimes. There can be individual responsibility and individual liability for those who have been aiding and abetting or enabling such crimes.
Von der Leyen is not the only official that should be prosecuted, nor even the worst. Keir Starmer and his regime are militarily assisting Israel’s genocide and waging war on freedom of speech and those in the UK who speak out against it.
The headline and content of this article have been amended to reflect a clarification by Ms Albanese that she was calling for officials not to “be allowed to evade accountability over the crimes they may have enabled in Gaza” rather than specifically for them to face trial.

Thanks Dave Hansell, the question is why Russia had to remain an enemy after the Soviet Union collapsed, after all both Yeltsin and Putin were capitalists who wanted Russia to take its place in Europe and sell the vast mineral riches which Russia’s 11 Time zones had in abundance. The US led West had other ideas i.e. US hegemony to be achieved with the expansion of NATO, gradually surrounding Russia and placing NATO bases and missiles several minutes flying time from Moscow. What could possibly go wrong, [remember Cuba]? The Powers that be thought Russia was weak and that NATO aggression would have to be accepted. How wrong that has been proven, now we are at the end stage of US hubris, and who will have to accept their hegemony is over, and a new power in the world is emerging, the BRICS led by Russia and China. The West will just have to get used to it, or use nuclear weapons.
