Breaking: ICC issues Netanyahu, Gallant arrest warrants

Keir Starmer must now confirm his government will comply with international law

The International Criminal Court has finally issued arrest warrants for Israeli PM Benjamin Netanyahu and former Defence Minister Yoav Gallant, confirming it believes they have committed war crimes.

The warrants state that:

both individuals intentionally & knowingly deprived the civilian population in Gaza of objects indispensable to their survival, including food, water, & medicine & medical supplies, as well as fuel & electricity.

The months-long delay and reports of US and Israeli pressure and even blackmail and threats had led to concerns that the warrant would not be issued, but the UK and every member of the ICC are now legally obliged to arrest the pair if they set foot on their territory.

Keir Starmer and his government must immediately confirm they will do this.

    “Article 259
    Individual criminal responsibility
    1. The Court shall have jurisdiction over natural persons pursuant to this Statute.

    2. A person who commits a crime within the jurisdiction of the Court shall be individually responsible and liable for punishment in accordance with this Statute.

    3. In accordance with this Statute, a person shall be criminally responsible and liable for punishment for a crime within the jurisdiction of the Court if that person:

    (a) Commits such a crime, whether as an individual, jointly with another or
    through another person, regardless of whether that other person is criminally
    responsible;

    (b) Orders, solicits or induces the commission of such a crime which in fact occurs
    or is attempted;

    (c) For the purpose of facilitating the commission of such a crime, aids, abets or
    otherwise assists in its commission or its attempted commission, including
    providing the means for its commission;

    (d) In any other way contributes to the commission or attempted commission
    of such a crime by a group of persons acting with a common purpose. Such
    contribution shall be intentional and shall either:

    (i) Be made with the aim of furthering the criminal activity or criminal
    purpose of the group, where such activity or purpose involves the
    commission of a crime within the jurisdiction of the Court; or

    (ii) Be made in the knowledge of the intention of the group to commit the
    crime;

    (e) In respect of the crime of genocide, directly and publicly incites others to
    commit genocide;

    (f) Attempts to commit such a crime by taking action that commences its
    execution by means of a substantial step, but the crime does not occur because
    of circumstances independent of the person’s intentions. However, a person
    who abandons the effort to commit the crime or otherwise prevents the
    completion of the crime shall not be liable for punishment under this Statute
    for the attempt to commit that crime if that person completely and voluntarily
    gave up the criminal purpose.3 bis. In respect of the crime of aggression, the provisions of this article shall apply only topersons in a position effectively to exercise control over or to direct the political ormilitary action of a State.

    4. No provision in this Statute relating to individual criminal responsibility shall affect
    the responsibility of States under international law”

  2. Sound. Let’s hope the Iranians, malaysians – or any other state opposed to the genocidal bastards – can organise a (successful) snatch squad, like the israelis did with eichmann.

    And don’t bother with the expense of an unnecessary trial, we’ve all seen plenty of evidence – just hang them.

It sounds as though the releasing of these Arrest Warrants means it is legally binding on countries which fall under the jurisdiction of the ICC to arrest Netanyahu if he enters these countries, particularly the US and UK, where the onus is on them in particular to arrest Netanyahu. What happens though if Netanyahu remains in his bunker and fails to come out of his bunker and fails to leave Israel? Will someone come and arrest Netanyahu if he stays in Israel forever now and does not leave. The timing of this is also very interesting because it comes just days after the announcement by the Supreme Court in Israel for Netanyahu to attend on 2 December with regard to the corruption charges he is so desperate to avoid. If he attends the Israeli Supreme Court could he be arrested for his crimes of genocide as well as those corruption charges? Interesting times ,but I will believe Netanyahu has been placed under arrest when I actually see it with my own eyes, but it seems the people responsible for arresting Netanyahu have taken extraordinary steps to avoid doing this, so I guess we shall just have to wait and see what happens.

Almost forgot, does Starmer’s attempt to redefine genocide and what Netanyahu has been doing and Starmer very publicly supported, with that affect the chances of Starmer being hauled before the ICC in The Hague, or is he, say ,about, at least 90% likely to be in Court in The Hague, because I believe there is a country, or a couple of a countries which have called for Starmer and his Foreign Secretary to be sent to The Hague to face charges of being involved in the crimes by Netanyahu? How likely is it that Starmer will be sent to the ICC in The Hague?

For Netanyahu and Gallant, who was replaced as defence minister earlier this month, the chamber “found reasonable grounds to believe” that they “each bear criminal responsibility for the following crimes as co-perpetrators for committing the acts jointly with others: the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts”.

    This must surely mean a stop to any UK arms sales including F35 spare parts.
    On the 9th October 2023, Israel’s Defence Minister, Yoav Gallant, said on behalf of the Israeli government:
    “I have ordered a complete siege on the Gaza Strip. There will be no electricity, no food, no fuel. Everything is closed.”
    Starmer later said in an interview with Nick Ferarri
    Mr Ferarri asked Mr Starmer “A siege is appropriate. Cutting off power, cutting off water?” To which Mr Starmer replied “I think that Israel must have, does have, that right. It is an ongoing situation.” There is video evidence of this.
    Because his words condoned and encouraged the Israeli government’s illegal war crimes and in effect gave the Israeli government the green light to deprive the population of Gaza food, water and energy, in effect condemning them to death, Mr Starmer’s comments were directed against all the Palestinian inhabitants of the Gaza Strip. Should not Starmer be in the frame also for encouraging the crime?

  6. Starmer, Biden and co. need to also be served with their Warrants of arrest for their parts in the
    the Genocide. They too have committed war crimes.
